1. Data Controller

1.1 The data controller is Hôtel Burnichon, whose registered office is located at 1600 RTE NATIONALE 7, 69490 VINDRY-SUR-TURDINE (hereinafter « Hôtel Burnichon »). As such, Hôtel Burnichon – and/or its service providers acting on its behalf – determines the purposes and the technical and legal means of processing personal data and undertakes to take all necessary organizational measures to ensure secure and lawful processing in accordance with the law of December 8, 1992, on the protection of privacy with regard to the processing of personal data (hereinafter, « the Law ») and the European Regulation of April 26, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter « GDPR Regulation »).

1.2 Hôtel Burnichon is free to choose any natural or legal person who processes personal data on its behalf (hereinafter « the processor »). If applicable, Hôtel Burnichon undertakes to select a processor offering sufficient guarantees regarding the technical and organizational security measures of personal data processing.

9. User Rights

9.1 Hôtel Burnichon guarantees fair and lawful processing of users’ personal data.

9.2 Hôtel Burnichon guarantees the user’s right to access their personal data. In accordance with Article 15 of the GDPR Regulation, the user has the right to obtain from Hôtel Burnichon the following information (but not limited to) concerning their personal data:

a) The purposes of the processing; b) The categories of personal data concerned; c) The recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly recipients in third countries or international organizations; d) Where possible, the intended period for which the personal data will be stored, or if not possible, the criteria used to determine that period; e) The existence of automated decision-making, including profiling, as referred to in Article 22, paragraphs 1 and 4, and, at least in such cases, meaningful information about the logic involved, as well as the significance and expected consequences of such processing for the data subject.

9.3 Hôtel Burnichon guarantees the right to rectification and erasure of personal data to the user. In accordance with Article 16 of the GDPR Regulation, incorrect or inaccurate data can be corrected or erased at any time. The user must first make the necessary changes via their user account, and if such modifications cannot be made autonomously, they can request Hôtel Burnichon to process them. The user has the right to obtain the erasure of their personal data under the conditions set out in Article 17 of the GDPR Regulation.

9.4 Hôtel Burnichon guarantees the right to restriction of processing. The user has the right to obtain the restriction of processing of their personal data under the conditions set out in Article 18 of the GDPR Regulation.

9.5 Hôtel Burnichon guarantees the right to data portability. In accordance with Article 20 of the GDPR Regulation, users have the right to receive from Hôtel Burnichon the personal data concerning them in a structured, commonly used, and machine-readable format. They also have the right to transmit these data to another data controller without obstruction from Hôtel Burnichon, in cases provided by the GDPR Regulation.

9.6 Hôtel Burnichon guarantees the right to object to data processing. The user has the right to object at any time to the processing of their personal data when there are compelling and legitimate reasons related to their particular situation. Hôtel Burnichon will no longer process personal data unless there are legitimate and compelling reasons for processing that override the interests, rights, and freedoms of the user, or for the establishment, exercise, or defense of legal claims.

9.7 Hôtel Burnichon guarantees the right to lodge a complaint. The user has the right to lodge a complaint concerning the processing of their personal data by Hôtel Burnichon with the Data Protection Authority.

10. Limitation of the Data Controller’s Liability
